A crime occurs when a physical action (actus reus, "a guilty act") is combined with intent (mens reus, "a guilty mind"). A person convicted of a crime may be incarcerated, fined, or both. A criminal proceeding begins when the government, through a Prosecutor, indicts, accuses or cites a person for conduct that lawmakers have decided is illegal. The Prosecutor has a large staff of lawyers, law enforcement, detectives, sophisticated crime labs and experts, a huge budget, and a tremendous advantage. Our job is to challenge the government's case, to present your witnesses, to build your evidence and to take on the Prosecutor fact for fact.

         Crimes include both felonies (more serious offenses -- like murder or rape) and misdemeanors (less serious offenses -- like petty theft or jaywalking). Felonies are usually crimes punishable by imprisonment of a year or more, while misdemeanors are crimes punishable by imprisonment of a year or less.
