A crime occurs when a physical action (actus reus, "a guilty act") is combined with intent (mens reus, "a guilty mind"). A person convicted of a crime may be incarcerated, fined, or both. A criminal proceeding begins when the government, through a Prosecutor, indicts, accuses or cites a person for conduct that lawmakers have decided is illegal. The Prosecutor has a large staff of lawyers, law enforcement, detectives, sophisticated crime labs and experts, a huge budget, and a tremendous advantage. Crimes include both felonies (more serious offenses -- like murder or rape) and misdemeanors (less serious offenses -- like petty theft or jaywalking). Felonies are usually crimes punishable by imprisonment of a year or more, while misdemeanors are crimes punishable by imprisonment of a year or less.
